Fire Hydrant System
The fire hydrant system is

of a building by boosting the pressure in the hydrant
service when mains is not enough, or when tank fed.

Standard Terms and Conditions
01 Definition
“Buyer” means the organization or person who buys or agrees to
buy goods from the seller;
“Purchase Order” means an order for goods buy the buyer and
acknowledged by the seller.
“Conditions” means the standard terms and conditions of sale set
out in this document and (unless the context otherwise requires)
includes any special terms and conditions agreed in Writing
between the Buyer and the Seller.
“Delivery Date” means the date specied by the seller when the
goods are to be delivered
“Goods” means the articles that the buyer agrees to buy from the
seller;
“Total Cost” means the list of prices of the goods maintained by the
seller as amended from time to time; inclusive of Erection,
Commissioing, Transportation, Uploading (as pre-launch offer)
and excluding GST (as applicable)
“Seller” means Aakar Building Soltuions, O-1, Audumbar Plaza
Phase II, Audumbar Nagar, Kudal, Sindhudurg - 416 520.
02 VALIDITY OF OFFER & GOODS
This offer is valid for 30 days from the date of offer and thereafter
subject to our reconrmation. Acceptance of delivery of the goods
shall be deemed conclusive evidence of the Buyer‘s acceptance of
these Terms and Conditions
The quantity and description of the Goods shall be as set out in the
Buyer‘s Purchase Order
The Goods shall be required only to conform to the specication in
the Buyer‘s Purchase Order. Photographs are for illustrative
purposes only and may not match the product itself
03 DELIVERY OF THE GOODS
Unless otherwise agreed, delivery of the Goods shall take place at
the address specied in the Buyer's Purchase Order on the Delivery
Date and the Buyer shall be deemed to have accepted the Goods
upon their delivery.
The Buyer shall make all arrangements necessary to take delivery
of the Goods whenever they are tendered for delivery.
The Delivery Date specied by the Seller is an estimate only. Time
for delivery shall not be of the essence of the Contract
If the Buyer fails to take delivery of the Goods or fails to give the
Seller adequate delivery instructions at the time stated for delivery
(otherwise than by reason of any cause beyond the Buyer's
reasonable control or by reason of the Seller's fault) then, without
prejudice to any other right or remedy available to the Seller, the
Seller may:
store the Goods until actual delivery and charge the Buyer for the
reasonable costs of storage; or
sell the Goods at the best price readily obtainable and (after
deducting all reasonable storage and selling expenses) account to
the Buyer for the excess over the price under the Contract or charge
the Buyer for any shortfall below the price under the Contract
If delivery is delayed by industrial dispute or any circumstances
beyond the Seller's control then the periods for delivery shall be
extended by such a period as is reasonable in the circumstances.
Should any delay continue for a period exceeding six months then,
unless the parties agree to the contrary, the contract shall be
deemed to be terminated without any claim for compensation
against the Seller.
Risk shall pass on delivery of the Goods to the Buyer.
04 BUYER’S SCOPE
The certain aspects of Civil work is solely remains under Buyer’s
Scope only, thus the respective work process would be charged
additionally over and above the provided total cost, which includes

supply of scaffold system or ladder to work at height
power supply for construction work
drinking water supply
if situation occurs of Remote Monitoring then internet
connectivity is required at Invertor output
The following act of civil work would be attended by Seller, over
and above the regular benet given to the buyer as an pre-launch
05 TERMS & CONDITIONS
The supply and delivery of the material would be within 1 week
immediately from the date of technically and commercially clear
Purchase order received upon advance payment from the buyer.
Process completion period will be 20 days from the date of
order/advance received from buyer subject to continuous work pattern
short of any other interruption.
06 LIASONING
As a benefit of pre-launch of offer, the expenses incurred for obtaining
the Final Occupancy Certificate (Final NOC) for Completed Project from
the Fire Department through proper liasoning with the Authorities
having Jurisdiction (AHJ) is hereby included in the provided quotation.
07 WARRANTIES & LIABILITY
Subject to the conditions set out below the Seller warrants that the
Goods will correspond with their specication at the time of delivery
with below warranty aspects.
Equipment Warranty:
12 months from the date of delivery for Cameras and DVR
The above warranty is given by the Seller subject to the following
conditions:
the Seller shall be under no liability in respect of any defect in the Goods
arising from any drawing, design or specification supplied by the Buyer
the Seller shall be under no liability in respect of any defect arising from
fair wear and tear, willful damage, negligence, abnormal working
conditions, failure to follow the Seller's instructions (whether oral or in
Writing), misuse or alteration or repair of the Goods without the Seller's
approval;
Any claim by the Buyer which is based on any defect in the quality
or condition of the Goods or their failure to correspond with
specification shall (whether or not delivery is refused by the Buyer)
be notified to the Seller within three days from the date of delivery or
(where the defect or failure was not apparent on reasonable
inspection) within a reasonable time after discovery of the defect or
failure. If the Buyer does not notify the Seller accordingly, the Buyer
shall not be entitled to reject the Goods and the Seller shall have no
liability for such defect or failure, and the Buyer shall be bound to
pay the price as if the Goods had been delivered in accordance with
the Contract.
Without prejudice to the generality of the foregoing, the following
shall be regarded as causes beyond the Seller's reasonable control:
act of God, explosion, food, tempest, fire or accident;
war or threat of war, sabotage, insurrection, civil disturbance or
requisition;
acts, restrictions, regulations, bye-laws, prohibitions or measures
of any kind on the part of any governmental, parliamentary or local
authority;
import or export regulations or embargoes;
strikes, lock-outs or other industrial actions or trade disputes
(whether involving employees of the Seller or of a third party);
difficulties in obtaining raw materials, labour, fuel, parts or
machinery; and
power failure or breakdown in machinery.
08 CANCELLATION CHARGES
After issuance of Buyer’s Purchase order, if buyer calls for
cancellation of the said Purchase order then, seller is deemed to
acclaim beneath dues from buyer, without prejudice to any other
right of buyer or any other remedy of any jurisdiction, in following
manner:
1. Purchase order t for cancellation only within 15 days after the
date of issuance of the same.
2. The cancellation clause and dues are admissible only in following
form:
a. The following cost is set for deduction as cancellation
dues towards buyer, which is acquired at the time of issuance
of Purchase Order from total advance amount
i. Material Cost
ii. Labor Cost, Civil Work Cost and Liasoning Cost, if any
iii. Erection, Commissioning , Uploading, Transportation
if any
iv. After deduction of cost as mentioned in clause 2(a)(i)
to 2(a)(iii) 50% amount shall set for deduction from the
balance advance amount directed towards cancellation
charges.
